1.SERVICES: dammerinteriors shall, as where appropriate perform the following:
Determine clients design preferences and requirements Conduct an initial design study in relation to the interior.
Provide visual references and other materials to generally show suggested interior design concepts, to include atmosphere, furnishings, fabrics, colour palettes, interior finishes, wall coverings, floor coverings, lightning, window treatments, styling ideas, art, accessories and any other interior enhancements.
Liaise with client to discuss and refine design concepts and ideas evaluation and inspection of samples, a final agreement between dammerinteriors and client will be made as final interior design concepts.
On acceptance of the preliminary design phase, dammerinteriors will prepare a pre final detailed design presentation including full colour perspective boards complete drawings showing furnishings and light fixture window treatments, floor and styling treatments. After approval any changes made in the design package must be in writing and must be approved by dammerinteriors and the client. If CAD drawings are required (three dimensional computer generated renderings) are available upon request and are additional cost.
PURCHASING- dammerinteriors shall prepare and submit for clients approval estimates for the purchase of merchandise. Merchandise to be purchased through dammmerinteriors will be specified in writing and

submitted in each instance for the client’s approval. Each estimate will identify the item to the client shall be the amount charged by dammerinteriors by the supplier of such item plus dammerinteriors purchase fee of 10%. If installation is required, an estimate for such a service will be completed upon request.
No item shall be ordered with out client’s approval in writing and returned to dammerinteriors with required payment equal to 100% of the clients price.
Purchase orders by dammerinteriors shall identify the item, price, applicable sales tax and freight cost.
A deposit fee of 50% of the client price is due prior to issuance of purchase orders. The balance will include delivery, shipping handling charges and applicable taxes and is payable when the item is ready for delivery. Proposals for fabrics wall coverings, art, accessories and items purchased at auctions or a retail store require full payment at time of signed proposal.
dammerinteriors shall be responsible for keeping project account records and such records shall be made available for the client.
dammerinteriors will furnish their completed detailed design concept, including all necessary items such as floor plans, architectural drawings, colour photographs or renderings and colour sample boards and specifications, in sufficient numbers to allow dammerinteriors to solicit request for proposal from those firms qualified to perform the furnishing phase. The cost of duplicating the design package in sufficient numbers will be borne by the client as part of the design fee. Furnishings will be itemised separately, identified by individual article and price per item at current wholesale cost and submitted to the client with the design package.
MERCHANDISE-Custom merchandise is non refundable. Custom merchandise will be identified on the purchase orders. All sales of custom merchandise are final.
dammerinteriors shall be responsible for receipt inspection and installation acceptance on behalf of client of furniture, furnishings and equipment at time of delivery. Should the merchandise arrive damaged dammerinteriors shall inform the client and schedule a replacement merchandise to be sent. The client shall not be responsible to pay any additional freight costs nor if goods arrive damaged.
Should the client return any merchandise other than damage purchased through dammerinteriors the client must pay a restocking fee plus cover the cost of freight to return the item to the vendor. All returns shall be in the original packaging unused and undamaged.

Furnishings/merchandise normally arrive in heavy packaging dammerinteriors shall remove packaging at client cost.
dammerinteriors cannot guarantee that actual prices for merchandise and/or interior installations or other costs or services will not vary either by item or pursuant to direct contracts with the client.
If dammerinteriors has not been involved in the preliminary functional planning and if construction is involved, dammerinteriors will review the architects plans at the 30% completion stage. In the interest of better utilisation of space and to prevent duplication of effort and material such as floor finishes, coordinating on the plans on the time. dammerinteriors will make recommendations for any changes to improve the functional concept to the client, with written justification, covering those area or items effected.
THIRD PARTY CONTRACTORS AND INSTALLERS dammerinteriors is not responsible for performance, quality, timely completion means, methods, techniques, sequences or procedures of construction, fabrication, procurement, shipment, delivery or installation or for safety precautions and programmes in connection with work performed by third party contractors and/installers since these are solely the third party contractors and/or installers responsibility under their respective contracts.
dammerinteriors will mange and/or schedule any or all third party contractors/installers for estimates, delivery or other purposes and coordinate schedules and create timeline based thereon.
dammerinteriors will provide constant observation of all third party contractors/ and or installers work at the project site. eg Window treatments, wall treatments and art installers require a representative from dammerinteriors to remain present at the project the entire time involved to complete the installation.
dammerinteriors will review all third party contractors and installers work to determine whether work is proceeding in general conformity with design concepts and specifications
PAYMENT- dammerinteriors will charge 10% administration fee on third party contractors. Receipts will be shown and spread sheeted with third party expenses.
client shall pay 10% merchandise charge, for all items purchased by dammerinteriors trade sources on your behalf, purchasing orders, expediting and invoicing, including reimbursable expenses.
Client shall pay dammerinteriors a hourly fee of ____pr hour. dammerinteriors shall invoice spread sheet of time schedule and services

Client shall reimburse dammerinteriors for any out of pocket expenses related to project. eg long distance travel, duplication services, postage or permits etc. receipts will be supplied.
INSURANCE-dammerinteriors has professional liability insurance at own expense.
PHOTOGRAPHY- Client agrees to permit dammerinteriors to photograph the project upon completion. dammerinteiors will be entitled to use such photos for portfolio and business purposes, but dammerinteriors shall not disclose the project location or client name with out clients prior written approval
LIMITATION OF LIABILITY-Client holds dammerinteiors harmless for any claim, loss, damage or injury to any person or property arising, either
directly or indirectly, from contractor’s performance.
CANCELLATION Both client and dammerinteriors reserve the right to cancel this agreement upon not less than__7 days_______days notice should either party fail substantially to perform in accordance with the terms of this agreement through no fault of the party initiating the termination. In the event of a cancellation not the fault of louise dammer, client shall be liable for any and all balances owed in full including but not limited to fees for services rendered, reimbursable expenses, pending purchase orders as of the cancellation date, etc
TERM The term of the agreement shall begin on ________/_______/___20__and shall continue until terminated by either party .Termination requires the terminating party to give prior notice to the terminating party.
AGREEMENT-shall be in accordance with the laws of Victoria, Australia
